Eligibility

Who can become a Member Nominated Trustee Director (MNTD)?

Any employee, deferred or pensioner members who are aged over 18 can be nominated to stand.

You will be disqualified from standing as an MNTD if you:

  • have been convicted of an offence involving dishonesty or deception (unless the conviction is spent).
  • are an undischarged bankrupt, or have entered into certain other voluntary agreements with creditors.
  • have been disqualified by law from being a director of a company (which includes former directors of companies that have entered insolvency proceedings).
  • have property in Scotland which is covered by a sequestration order.
  • are in a company where any director of the company has been disqualified from being a trustee.
  • are in a Scottish partnership where any of the partners has been disqualified from being a trustee.
  • have been suspended, prohibited or disqualified from acting as a trustee by The Pensions Regulator or previously by the Occupational Pensions Regulatory Authority.
  • are a widow, widower, surviving civil partner, or dependent of a Scheme member.

Employee, deferred and pensioner members are defined as:

  • Employee members are members who are currently employed by Heidelberg Materials and in active membership of the Scheme.
  • Deferred members are members who are neither in pensionable service nor in receipt of a pension under the Scheme.
  • Pensioner members are members who are currently in receipt of a pension from the Scheme earned through their own membership, rather than through being the survivor of a deceased member.

MNTD Policy

An MNTD will cease to be a Trustee Director for the Scheme in the event of any of the following:

  • are no longer a member of the Scheme.
  • cease to be an employed deferred member if they were the only MNTD in that status at that time.
  • are convicted of an offense involving dishonesty or deception (or if new information surfaces regarding a prior conviction).
  • are declared bankrupt or enter into an undischarged arrangement with creditors.
  • become disqualified from acting as a trustee of any pension scheme by pension laws or as a company director under company laws.
